Attorney plans to file suit against city

A Clovis attorney representing the family of a 3-year-old drowning victim said he plans to file a lawsuit against the city sometime in the next two weeks.

Michael T. Garrett of Clovis said he is working with an Albuquerque law firm and will file suit in federal court in Albuquerque, seeking “the maximum the law allows” for the family of Jequon Haynes. The child drowned July 13 in Clovis’ Potter Park Pool.

Clovis City Manager Joe Thomas said the city has received a tort claim, or notice of intent to sue. He said any lawsuit resulting from the incident would be handled primarily by the city’s insurance carrier and he declined additional comment on the case.
